Aunt Marion lived in two houses in the 1940's and 1980's: the first housewas next door to Uncle Bill's house on Kenridge, and the second was at3697 Lansdowne. Both were in Cincinnati suburbs, and both were standingin very good condition when my mother and I visited the neighborhoods onApril 29, 2001.

Aunt Marion was a small, somewhat stocky woman with a fine intellect anda wonderful, gentle sense of humor. She and Uncle Bill both seemed tohave their father's good-humored personality. In contrast, their olderbrother, James Clifford (my grandfather) was more serious and withdrawn.Aunt Marion appears to have been named in honor of one of her mother'ssisters who died in infancy. The female name "Marion" occurs frequentlyin a variety of McIlquham family lines.

Over the years, Aunt Marion had two German Shepherds. Both were named"Smokey". After the first dog died, he was always referred to as "OldSmokey". I was terrified of Old Smokey, because he was an old dog and notused to children, and growled at us when we walked by.

I always enjoyed going to Aunt Marion's house. I remember one visit inthe late 1950's when, instead of cooking, she sent someone out to thenewly-opened Frisch's Big Boy Drive-In to get hamburgers. That was myfirst taste of fast-food burgers, and it was a very special occasion tome!

Aunt Marion was bedridden with crippling arthritis in her later years,and in much pain. Since neither she nor Uncle Bill had children, sherelied on her brother Cliff's daughter, Janet, to take care of her. AuntJanet drove frequently from her home in Frankfort, Indiana, to attend toAunt Marion. Aunt Janet reported that, upon hearing of the prematuredeath [in March, 1984] of Janet's brother, Jim (my father), Aunt Marionwept and wondered aloud why God could not have taken her instead.

complexion.

"Edward was a Civil War veteran. One of his fingers was was Ruth E. Grandon Kelley's grandfather. She told me this saw a picture of him that clearly showed the finger missing. ask which one cause I don't remember."

The undersigned Auditor, appointed by this Court to pass upon exceptions, ascertain claims and make distribution of the the hands of A. J. Scott, Executor of the will of Samuel deceased to and among the parties legally entitled thereto respectfully represents.
That having obtained his certificate of appointment and qualified your Auditor fixed his office in the Allison High Street,Waynesburg, Pa., as the place and Wednesday April at 10 A.M. as the time, when and where all parties interested exceptions filed to the Account of said A. J. Scott and in the distribution of the balance in the hands of said executor were requested to attend and to be heard. Notice of said time and having been accepted on March 22, 1905 by J. R. Pipes, James and T. H. Wilkinson attorneys for the parties in interest notice and acceptance of service theeof is hereto appended and part of this report.
That on March 22, 1905 parties met in pursuance of the them and adjorned until April 19, 1905 at which time Mr. J. R. attorney for Edward Grandon, Mr. James Inghram attorney for Scott, accountant and T H. Wilkinson attorney for Cephas appeared. Your Auditor took the testimony accompanying this the appendix thereto and adjourned until May 9, 1905; when the exceptions and other matters peresented before your Auditor argued by Mr. Inghram and Mr. Pipes, and from the evidence before him, your Auditor finds the follow (sic) conclusions of 1. It does not appear from the evidence offered, but we examination of the records of the probate of the will of said decedent, Samuel Roberts, that he died at his late residence Borough of Waynesburg, Greene County, Pa. on May 23, 1900 and best of our knowledge unmarried and without leaving any issue surviving him. That the said decedent left a will dated February 16, 1899; which was duly probated and registered in Office of the Register of Wills in Greene County, Pa., on the of June 1900, in Will Book No. 8, page 439, a copy of which is attached to the Appendix to this report and marked Exhibit that Letter Testamentary were issued by the Register of Wills aforesaid to A. J. Scott, executor named in the will on June and the said A. J.Scott took charge of the Estate of the said testator, which consisted of certain personal property and situate in the Borough of Waynesburg, Pa. as shown by the copy Inventory attached to the Appendix hereto and marked Exhibit the account attached and marked Exhibit "D".
2. That the said A. J. Scott, Executor managed and said Estate both as executor and as Trustee for one Hulda pursuance of the directions contained in the will of the said decedent, until July 25, 1904; when he filed his final account executor of the last will and testament of Samuel Roberts account also included his receiptsand expendatures (sic) as the said Hulda Grandon /deceased and shows a balance in his $361.96. The said account was presented at No. 12 September 1904, when Cephas Roberts filed six exceptions to the same, exceptions are attached to the Appendix to this report and Exhibit "E". Your Auditor was appointed to pass upon and distributive the foregoing balance to the parties legally thereto.
Not more than one of the exceptions could be sustained by Auditor under the evidence presented before him. Upon of all the evidence your Auditor is of the opinion that the charged bythe accountant; which were made the subject of the exception, were excessive. Under the facts and the Law as your Auditor finds he does not deem it necessary to go into the the exceptions filed for the reason that the said exceptions filed by a person who has any interest in the estate of the Samuel Roberts, deceased, and therefore should not have been

Samuel Roberts, in his will directs that "at the niece, Hulda Grandon, I give, devise and bequeath the rest, and remainder of my estate to the children of my sister divided between them share and share alike." the balance Auditor for distribution is the residue and remainder of said testator's estate --- We find that said testator's sister Roberts, had two illegitimate children, Cephas Roberts and Roberts, and that afterwards she married one Jared Grandon by had several children, all of whom died intestate, unmarried and without issue prior to the date of the death of said Rebecca except three who survived her, to wit Hulda Grandon, Samuel and Edward Grandon. Hulda Grandon is the niece mentioned in foregoing will and she is now dead. Cephas Roberts, one of the illegitimate sons of Rebecca Roberts Grandon files the only to the executors account. Cephas Roberts and his wife Ann had some litigation and trouble with testator in his lifetime which terminated in a Law suit or suits......

The counsel for the accountant first request that the should be dismissed because Cephas Roberts being an of Rebecca Grandon, has no interest whatever in the fund for distribution or in testator's estate and theefore had no file exception.
Counsel for accountant and counsel for Edward Grandon also that testator be the fifth clause in his will intended to the legitimate children of his sister Rebecca Grandon, Samuel Edward Grandon and for that reason Cephas Roberts and Lemuel are not entitled to participate in this distribution.
We will take up and dispose of the last proposition first. the testator intend to distribute his estate among the heirs of Rebecca Grandon deceased, or did he intend to divid it between her legitimate children, Samuel and Edward Grandon: of April 8, 1833 relating to the distribution of decedents provides that "The provision of this Act relative to distribution of real and personal estate among the descendants collateral relations of intestatees shall be constructed to persons only as have been born in lawful wedlock.
Under this Act of Assembly the Supreme Court of this State per curiam the report of an Auditor finding that an no right to inherit from his uncle by representation through mother.

Whenmy mother and I visited the neighborhood on April 29, 2001, the house andgrounds were in immaculate condition, although the house has been paintedbeige with brown trim.

Aunt Alma and Uncle Bill had no children. In the 1940's and '50's, theyhad a beautiful Irish Setter named Sandy. The little mixed breed dog thatmy family kept was also called Sandy, so when the families got together,we called them "Big Sandy" and "Little Sandy".
